Terms of Service

Family Tree by Replica Replica is a tool for keeping your own family record. It is fully free, and members fund it voluntarily. You are the author of your tree and you are responsible for what you put on it. We will keep the service running, take security seriously, and be honest about what changes.

This page is the long version. It applies to everyone who uses familytree.replicareplica.xyz.

Family Tree is operated by a sole trader trading as Replica Replica, registered in Australia. References to “we”, “us”, and “our” mean Replica Replica. You can reach us at support@replicareplica.xyz.

You can create one account by signing up with an email address and a password. Keep your credentials safe. If you suspect someone else has signed in to your account, change your password and let us know.

By creating an account you confirm you are at least 13 years old. If we learn that an account belongs to a child below this age we will close it and delete the data on request.

You are the author and sole curator of every tree on your account. You decide who is on it, what is recorded, and what stays private. The product is intended as a personal genealogy record, not a system of record for legal, medical, inheritance, or government purposes. Keep your own export as a backup if a copy outside our service matters to you.

You retain ownership of everything you record. You grant us only a limited licence to host, store, process, render, and back up your data so the service can work. We do not use your tree to train models, and we do not show your tree to anyone else.

Genealogy is unusual: a tree contains personal information about people who did not sign up for our service. By using Family Tree you agree to:

• Only record information about identifiable third parties where you reasonably believe the third party would not object, or where the information is already part of public family record.
• Be careful about sensitive information (causes of death, religion, medical conditions, photographs of living people) and treat it with the consent the person would expect.
• Promptly remove or correct information when a third party asks you to, whether through us or directly.

These obligations apply identically to records you typed in by hand and to records you imported from a GEDCOM file or other format. Importing a third-party file does not change your obligations as the author of the tree.

If a third party contacts us asking what is held about them or asking for removal, we will follow the process described in the Privacy Policy. The short version: we contact the tree owner with a 30-day removal request, remove the disputed fields if the owner does not respond, and tell the requester the outcome.

You may not use the service to:

• Do anything that is illegal under Australian law or the law of the place where you are.
• Harass or target an identifiable third party.
• Impersonate an identifiable real third party. Fictional characters and what-if trees are fine. Templates we ship are fine. Pretending to be someone you are not, in a way that could mislead anyone, is not.
• Resell access, scrape the service for commercial purposes, or build a competing product on top of our database.
• Probe, scan, penetration-test, or otherwise abuse the security of the service without our written permission. Good-faith research reported to security@replicareplica.xyz is welcome and is not covered by this rule.
• Spam, mass-register accounts, or run automated abuse.

If we think you have crossed one of these lines we will normally try to email you first when the situation is borderline. We will also reply if we got it wrong. Suspension or termination is the last resort, not the first one.

A note on speculative or AI-generated lineages: trees are for genuine personal genealogy. Speculative or machine-generated lineages are discouraged but not forbidden. You are the author of your tree and you are responsible for what you record on it.

Family Tree is fully free. There are no caps and no feature gates. If you want to support the service you can become a member from the membership page. Membership is a voluntary one-time payment in Australian dollars. There is no recurring billing.

Members get a small “Member since” mark and our thanks. They do not get any product features that other users do not.

No refunds

Membership is non-refundable from the moment of payment. The amount is small and the framing is voluntary support, not a purchase, so there is no refund window and no refund process. The checkout page makes this explicit before you confirm. If a payment is genuinely disputed (fraud, accidental double-charge, checkout error) you can raise a chargeback through your card issuer as you would for any other transaction.

We do all of this on a single sole trader's budget. The service runs on cloud infrastructure with no formal uptime guarantee. We watch it, we fix things when they break, and we maintain backups. We do not promise an SLA.

We may need to take the service down for maintenance from time to time. We will try to give notice when we can.

To the maximum extent permitted by law, our total liability to you for anything arising out of your use of the service is capped at the total of any membership amounts you have paid us in the 12 months before the event giving rise to the liability. For someone who has never paid, that cap is zero Australian dollars.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (including section 64A of the Australian Consumer Law) or any other applicable law.

Family Tree is a personal genealogy tool. It is not a legal record, a medical record, or an inheritance record. We do not verify the accuracy of anything you record. If a copy of the data outside our service matters to you, export it and keep your own backup.

By you

You can leave at any time by deleting your account at /settings → Delete account. No notice is required. The deletion is hard: the account, every tree, and every person on it is removed immediately. We hold an encrypted backup for up to 30 days against operational mishap and then purge it.

By us

We may suspend or terminate an account for a serious or repeated breach of the acceptable-use rules above. Where we do, we will normally suspend the account first (you cannot sign in, but the data is frozen) for 30 days, and then hard-delete it. If we reverse the decision during the 30 days the account comes back with the data intact. After the 30 days the deletion is the same as the user-initiated one above.

If you believe you have found a security issue, please email security@replicareplica.xyz. We commit to a 90-day responsible-disclosure window before any public disclosure, and we will not pursue legal action against good-faith research that respects that window. We do not run a bug bounty programme.

These terms are governed by Australian law. Any dispute may be brought before the courts of New South Wales, Australia, on a non-exclusive basis. The non-exclusive submission means a consumer can still sue locally if the law of their home jurisdiction allows it.

Cosmetic edits (typos, link fixes, clearer wording) ship without notice. The “Last updated” date at the top of the page changes when they do.

Material changes trigger an email to all account holders with the amended text and a 30-day notice before the change takes effect. Material means: narrowing your rights, increasing your liability, expanding the categories of data we collect, or introducing a new third party that processes your data on our behalf.

If you do not agree with a material change you can delete your account before the change takes effect. Continued use of the service after the notice period means you agree to the new terms.
